For what purpose do we process your personal data and what is the legal basis?

The personal data provided by the user will be processed by THE ENTITY for the following purposes:

PURPOSE 1: Contact > Website inquiry

Description of the purpose: The personal data of users who contact THE ENTITY through the inquiry form made available on the website will be processed for the purpose of managing said inquiry, responding to requests received through it.
Legal basis: The processing is based on consent.
Data processed for this purpose: Identifying and contact data (name, surname, email address, phone number) and any other type of data that may be provided by the user by completing the form.

PURPOSE 2: Contact > Website visit

Description of the purpose: The personal data of users interested in visiting our facilities will be processed for the purpose of processing the request made by the user and, where applicable, managing the requested visit and subsequently publishing the images of the visit in the media and on THE ENTITY's website and social networks.
Legal basis: The data subject gives their express and explicit consent to the processing of their personal data for one or more specific purposes.
Data processed for this purpose: Identifying and contact data (name, surname, phone number, email address...) and any other type of data that may be provided by the user by completing the form and during the visit.

PURPOSE 3: Contact > Work with us

Description of the purpose: The personal data of users who wish to participate in our recruitment processes will be processed for the purpose of managing the receipt of CVs sent to THE ENTITY, as well as for the management and control of THE ENTITY's selection processes, specifically, to obtain a complete professional and personal profile that allows evaluating the suitability of the candidate in the ENTITY's recruitment processes.
Legal basis: The data subject gives their express and explicit consent to the processing of their personal data for one or more specific purposes.
Data processed for this purpose: Identifying and contact data from the form (name, surname, email address), identifying and contact data from the CV submitted (phone number, postal address, national identity document...), data on personal characteristics and social circumstances (date of birth, sex, marital status, number of children...), academic and professional data and other data that the CV may contain.

PURPOSE 4: Ethics channel of the website

Description of the purpose: To identify infringements, irregularities or breaches committed within THE ENTITY and, if applicable, to initiate the corresponding investigation.
Legal basis: Compliance with Law 2/2023, of 20 February, regulating the protection of persons who report regulatory infringements and the fight against corruption.
Data processed for this purpose: identifying and contact data (name and surname, email address, phone number, national identity document, postal address) and other categories of data that may be provided by users when communicating with THE ENTITY.

PURPOSE 5: Cookie management of the website

Description of the purpose: If you accept our Cookie policy, in particular our analytics, personalisation and advertising cookies, user data may be processed in accordance with the provisions of the Cookie policy.
Legal basis: The data subject gives their express and explicit consent to the processing of their personal data for one or more specific purposes.
Data processed for this purpose: Browsing data (IP address and the domain from which access is obtained, date and time of the visit, etc.).

PURPOSE 6: User management > Contracts and certificates of the website

Description of the purpose: The personal data of users will be processed for the purpose of providing the services enabled through the website, such as registering as a client of THE ENTITY, modifying their data, registering a construction site or requesting waste delivery certificates. The personal data of users will be processed to formalise the contracts or waste delivery certificates, provide the requested services and invoice them if applicable, contact the users themselves in relation to the services provided, including communications by electronic means, carry out satisfaction surveys to evaluate the quality of the service provided, respond to information requests from the Administration that owns the service and comply with legal obligations.
Legal basis: The processing is necessary for the performance of a contract to which the data subject is party or for the application of pre-contractual measures at their request, in addition to THE ENTITY's legitimate interest in knowing the opinion of users regarding the service provided and in responding to information requests from the Administration that owns the service.
Data processed for this purpose: Identifying and contact data (name, surname, national identity document, postal address, email address, phone number), goods and services transaction data (goods and services received by the user, financial transactions), economic and financial data (payment data) and any other type of data that may be provided by the user by completing the forms or in satisfaction surveys, in addition to that derived from the provision of the service itself.

PURPOSE 7: User management > Client area of the website

Description of the purpose: The personal data of users who wish to access the personal or private area for clients will be processed by THE ENTITY for the creation of a user account that will allow them to access the user's personal or restricted access area.
Legal basis: The processing is necessary for the performance of a contract to which the data subject is party or for the application of pre-contractual measures at their request.
Data processed for this purpose: Identifying and contact data (name, surname, email address, phone number...), and goods and services transaction data (goods and services consumed).

What personal data must you provide us with in each case?

THE ENTITY informs users that when personal data is collected through a form made available on our website, the user must provide at least those data marked with an asterisk (*). If such data, considered necessary, is not provided, THE ENTITY will not be able to process your request.

How long do we keep your personal data?

The data provided by the user will be kept for as long as necessary to effectively fulfil the purposes indicated above. If legal deadlines apply, they will be kept until the end of these deadlines or until any associated legal actions expire.

If you have sent us a CV, the document will be valid for one year. After this time, it will be destroyed, so you will need to send a new and updated CV if you wish to continue participating in future selection processes. However, we will keep your data for the periods provided for in applicable legal provisions and for as long as necessary to address possible responsibilities arising from the processing.

With whom do we share users' personal data?

The following data transfers are foreseen:

  • To Public Administrations when necessary in accordance with the regulations in force at any time, as well as to judicial authorities and State Security Forces and Bodies when necessary.
  • Our company is part of the URBASER Group, so data transfers to companies within the group are foreseen. This communication will be carried out for the same purpose and retention periods for which the data subject has been informed.
  • Web analytics service providers: The use of these tools may imply an international data transfer outside the European Economic Area.
  • To the data processors that MAC Insular S.L. may designate to manage the purposes indicated above.

What are the rights of users?

The user may exercise their rights of access, rectification, erasure, portability, and restriction or objection by writing to the offices of MAC Insular S.L., at the address mentioned above, or by sending an email to the following address personal@mac-insular.com. In both cases, the identity of the person exercising their rights must be proven. If this is not sufficient, additional information may be requested.

Likewise, data subjects have the right to withdraw their consent and to lodge a complaint with the Spanish Data Protection Agency (https://www.aepd.es/)

Security measures

THE ENTITY adopts the necessary technical and organisational measures to guarantee the security of personal data and prevent its alteration, loss, unauthorised processing or access, taking into account the state of technology, the nature of the data and the risks to which they are exposed.

INFORMATION ON THE PROCESSING OF PERSONAL DATA CARRIED OUT AT THE FACILITIES

Video surveillance information clause

MAC Insular S.L. informs you that VIDEO SURVEILLANCE systems have been installed at the company's centres for the purpose of controlling the security of the perimeter of the facilities and access, labour control and checking vehicles entering the plant.

The images obtained will be stored for a maximum period of one month, except for images that must be handed over to the competent public bodies, State security forces and bodies, and judges and courts.

The legal basis for the processing of data is Public Interest, since the purpose is to guarantee the safety of people, property and facilities; the legitimate interest of MAC Insular S.L. to control the security of these facilities and the public service provided, as well as the workers' statute.

We also inform you that your data may be made available to the competent public bodies, State security forces and bodies, and judges and courts, whenever MAC Insular S.L. has a legal obligation to provide them. Except in the previous case, data will not be transferred to third parties. The data processor is the security company Tècnics Auditors de Seguretat i Protecció Balears, S.L. (TASP SEGURETAT).

You have the right of access (to know what data we process and how we process it), erasure (to delete data when processing is no longer necessary), objection and restriction of processing. On the website of the Spanish Data Protection Agency (AEPD) you will find a series of models that will help you exercise your rights. MAC Insular, S.L. undertakes to process your data with absolute confidentiality and informs you that it has implemented the necessary technical and organisational security measures to guarantee the security of your data and prevent its alteration, loss, unauthorised processing and/or access.

Information clause on access control

MAC Insular S.L. informs you that it will process your personal data (name, surname, national identity document, company or centre of origin) and other data related to access (person(s) visited, date/time of the visit) to record the access of visitors, collaborators and third parties to THE ENTITY's facilities, in order to guarantee the safety of people, property and facilities. The legal basis for the processing of data is the Data Controller's legitimate interest in the area of security at its facilities.

The data will be kept for as long as necessary to carry out the purpose of the processing and subsequently, for the period of limitation of actions that may arise from it. The data, where applicable, will be communicated to the Security Forces and bodies, judicial authorities and other entities authorised by law in cases where there is a legal obligation. No international transfer of your data is foreseen.
